1. Agreement

These Terms of Service ("Terms") govern your use of gettrampay.com and the Trampay mobile application (together, the "Service") operated by Trampay Ltda. ("the Company," "we," "us," or "our"), with offices at Av. Brigadeiro Faria Lima, 3477, 14 andar, Sao Paulo, SP 04538-133, Brasil. By creating an account or using the Service you accept these Terms. Nothing in these Terms limits your statutory rights under the consumer protection laws of Brazil or your country of residence.

2. What Trampay Does

Trampay is an income forecasting and alternative credit-building platform for gig delivery workers in Brazil. Through read-only API connections to delivery platforms you authorize (iFood, Rappi, Uber Eats, 99Entregas), the Company reads your delivery and earnings history to generate income forecasts, identify high-earning shifts, and build a credit profile that partner financial institutions may use when you choose to apply for a loan through the Trampay marketplace.

The Company is not a bank or lender. We do not offer credit, extend loans, or make lending decisions. Any credit product you access through the Trampay marketplace is provided by an independent partner financial institution, not by the Company. Nothing in the Service constitutes a guarantee or promise of loan approval.

3. Use of the Service

  • You must be at least 18 years old and have legal capacity to enter binding contracts under Brazilian law.
  • You agree to provide accurate, complete, and up-to-date information at registration.
  • You agree not to use the Service unlawfully, to interfere with its operation, or to attempt unauthorized access to our systems or the delivery platform APIs.
  • You may not scrape, reverse-engineer, or copy the Service except as expressly permitted by mandatory law.
  • You are responsible for maintaining the confidentiality of your account credentials.

4. Platform Connections

When you connect a delivery platform account, you authorize the Company to access that account via read-only API on your behalf. We never request or store your delivery platform username or password. You may disconnect any platform at any time through the Service settings. Disconnecting a platform ends the Company's ability to read new data from that platform and will affect forecast and credit-profile accuracy going forward, but does not automatically delete data already collected.

5. Credit Profile and Marketplace

The Company builds an alternative credit profile derived from your delivery earnings history. This profile is an informational tool designed to support your qualification process with partner lenders. The profile is shared with a specific partner lender only when you actively initiate a loan application through the Trampay marketplace and provide explicit consent. The Company is not responsible for lending decisions made by partner financial institutions, and does not guarantee that any application will be approved. Participation in the marketplace is entirely voluntary.

6. Subscription and Billing

Trampay offers a free Starter tier and a paid Plus tier. Paid subscriptions are billed monthly in Brazilian Reais (BRL) to the payment method you provide. You may cancel your Plus subscription at any time; cancellation takes effect at the end of the current billing period and you will retain Plus features until that date. Refunds are not provided for partial billing periods except where required by mandatory consumer protection law in Brazil.

7. Intellectual Property

The Service, including its software, design, text, and data models, is owned by the Company or its licensors and is protected by Brazilian and international intellectual-property law. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended personal purpose. Nothing in these Terms transfers ownership of any intellectual-property right to you.

8. User Content

You are responsible for any content you submit to the Service, including information provided at registration and support messages. You grant the Company a limited license to use, store, and process such content solely to provide the Service.

9. Disclaimers

Income forecasts produced by the Service are estimates based on historical delivery data and algorithmic modeling. They are not guarantees of future earnings. The Service is provided on an "as is" and "as available" basis. The Company disclaims all warranties to the maximum extent permitted by applicable law. Mandatory consumer warranties applicable under Brazilian consumer protection law (Codigo de Defesa do Consumidor - Lei n. 8.078/1990) are not affected by this disclaimer.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Company's total liability for any claim arising from or related to the Service will not exceed the amount you paid to the Company in the three months preceding the event giving rise to the claim, or BRL 100, whichever is greater. This limitation does not apply to liability that cannot be limited under mandatory Brazilian consumer protection law.

11. Indemnification

You agree to indemnify and hold harmless Trampay Ltda. from any claims, damages, or expenses arising from your use of the Service in breach of these Terms or your violation of any third-party right.

12. Termination

The Company may suspend or terminate your access to the Service for material breach of these Terms, with or without prior notice depending on the severity of the breach. You may terminate your account at any time by contacting [email protected]. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute arising from or relating to these Terms or the Service is subject to the non-exclusive jurisdiction of the competent courts in Sao Paulo, Brazil, without prejudice to your mandatory consumer-protection rights under Brazilian law.

14. Changes to These Terms

The Company may update these Terms from time to time. Material changes will be posted with a new "Last updated" date and, where appropriate, communicated by email or in-app notification. Continued use of the Service after the effective date of a change constitutes your acceptance of the updated Terms.
